This is an agreement made between sellyourjewels.com and you, the user accepting it. By continuing to use our website, it is deemed that you accept these conditions and agree to comply with its terms.

DEFINITION OF KEY TERMS

In this agreement (the “Agreement”) the following terms are used with the following meanings:

Appraise” / “Appraisal”
The assessment of a group of items by sellyourjewels.com, or the auction houses that we are affiliated with, considering authenticity, condition, weight, and likely market value to summarise a valuation for that group of items, resulting in sellyourjewels.com deciding either; to send a purchase offer to the user with a price we are willing to pay the user for that group of items, or to reject that group of items. 

“Business Hours”
09:00 – 17:00 on any working day.

“Contract”
If, as a result of the appraisal, sellyourjewels.com send a purchase offer to the user for a group of items, and the user accepts this purchase offer, a contract arises for the sale of a group of items from the user, to sellyourjewels.com. There is no legally binding contract in place until this point.

“Group Of Items”
Any number of items, including a single item, of the type specified in section 3 that you wish to sell to sellyourjewels.com in accordance with this agreement.

“Purchase Offer”
A verbal or written offer that sellyourjewels.com provide to the user in respect of a group of items that we would like to buy, and the price we are willing to pay the user for them.

“Reject / Rejection”
The decision by sellyourjewels.com to decline entering into an agreement with the user to purchase a group of items.

“Sellyourjewels.com” or “us”, “we”, “our”
The trading name of Trading British Group, registered company number 13152571

“User” or “You”
A user of this website.

“Website”
This website, sellyourjewels.com, or any other web-services or mobile applications on which you may sell your group of items to us, including social media.

“Working Day”
Any day except a Saturday, Sunday, or any day which is a public holiday in England or any day on which banking institutions are authorised or required by law or other governmental action to close.

2.  AGREEMENT PRINCIPLES

2.1         We reserve the right to vary this agreement (in accordance with clause 11.7). You agree to check the terms of this agreement on each occasion that you wish to send a group of items to us.

2.2         By using the website, you confirm that:

2.2.1      You are an individual consumer, legally capable of entering into a binding contract

2.2.2      You are the legal owner (or have consent from the legal owner) of all items in a group of items that you send to us.

2.2.3      You are at least 16 years of age or, if you are under 16 years of age, have obtained permission from a parent or guardian to send a group of items to us.

2.2.4      You are sending the items from a UK address and, if your items are to be returned to you, they will be sent back to a UK address.

3. ITEMS WE ACCEPT

3.1 We will appraise groups of items that fall into one or more of the following categories.

3.1.1      Jewellery, including Costume Jewellery

3.1.2      Gold, Gold Plate & Scrap Gold

3.1.3      Silver & Silver Plate

3.1.4      Timepieces including Wrist Watches, Pocket Watches & Clocks

3.1.5      Vintage & Collectable Toys

3.1.6      Old Currency

3.1.7      Cameras

3.1.8      Writing Instruments

3.1.9      Medals & Militaria

3.1.10    Diamonds

3.1.11    Antiques

3.1.12    Designer Items

3.1.13    Maritime & Vintage Tools / Equipment

3.1.14    Miscellaneous

3.2         At our discretion, we may appraise a group of items that do not fall into one or more of these categories. We reserve the right to refuse to appraise a group of items, even if it falls into one or more of these categories.

4. SENDING YOUR ITEMS

4.1         When we confirm that we are interested in buying your group of items, we will arrange a courier to collect your                            items from you and deliver them to us. Our main choice of service is

but we reserve the right to use a different service due to availability or                                      suitability.

4.1.2      You agree that sellyourjewels.com may place restriction on the type, size, or weight of items that you send to us. Your parcel must meet all the requirements as set out in clause 4.1.3, unless explicitly stated by us.

4.1.3      Parcel Requirements: Maximum Parcel Weight – 30.00kg, Maximum Parcel Length – 1.35m, Maximum Parcel Width – 0.70m, Maximum Parcel Height – 0.70m, Maximum Combined Parcel Length + Parcel Girth – 2.70m.

4.1.4      It is your responsibility to ensure your items are securely packaged. Sellyourjewels.com accepts no liability for groups of items which are damaged during postage because of being poorly or insufficiently packaged, or which you send in breach of the instructions received from us.

4.1.5      Parcels sent to us as set out in clause 4.1 are insured up to a value of £300.00. If you believe that the group of items you wish to send are worth more than £300.00, please call us to discuss before dispatching your group of items. We accept no liability for your decision to send a group of items worth more than £300.00, so please do not do so without discussing this with us first.

5. APPRAISALS

5.1         Once your group of items are delivered to us, we will send a parcel receipt email to confirm that we have received your items. We will appraise your items within one working day (during business hours) unless otherwise stated.

5.2         If, when completing an appraisal of your group of items, we believe they have been registered or reported as lost or stolen, or that any of your items could be counterfeit, we will notify you and keep the group of items in secure storage whilst we contact the relevant authorities.

5.3.        We may, at our discretion, appraise a group of items that does not fall into one or more of the categories, as set out in Clause 3.1. We reserve the right to refuse to appraise a group of items, regardless of if it falls into one or more of the categories, as set out in clause 3.1.

5.4         We reserve the right to only appraise some of a group of items, or to consider some of the items as separate and return them to you.

5.5         On completion of an appraisal, we will notify you of the outcome within one working day (during business hours) unless otherwise stated.

5.6         If we decide that we don’t want to buy your items, we will notify you of our decision and return your items to you, free of charge. If we decide we would like to buy your items, we will send you a purchase offer via email.

5.7         Due to fast-changing market trends, your purchase offer is valid for 72 hours from us sending it to you. To accept your offer, follow the link in your purchase offer email or notify us by emailing hello@sellyourjewels.com or calling 0800 4702313. We will then make payment for your group of items as set out in section 6 of this agreement.

5.8         You have the right to decline your purchase offer by notifying us by emailing hello@sellyourjewels.com or calling 0800 4702313. If you do this, your items will be deemed to be rejected, as set out in section 7 of this agreement.

5.9         By accepting your purchase offer as set out in clause 5.7, you are offering to create a binding legal contract between you and sellyourjewels.com in respect of the group of items set out in the purchase offer. Ownership of and title to the items set out in the accepted purchase offer will pass to sellyourjewels.com and we will pay you the sum detailed in the relevant purchase offer.

5.10       Neither title to, nor risk in, a group of items shall pass to sellyourjewels.com until a contract for the purchase of those items has arisen as per clause 5.9. Until that time, you will remail liable for any or all loss or damage to your group of items.

6. TERMS OF PAYMENT

6.1         Payments to users who enter into a contract with sellyourjewels.com will be made by bank transfer.

6.1.1      Sellyourjewels.com will make a bank transfer, using the details provided by you, within one working day (during business hours) of you accepting your offer to enter a contract. We will notify you by email once payment has been sent.

6.1.2      Bank transfers can take up to two days to clear after we have sent payment, and you should be aware that many banks only process transactions on working days. If a bank transfer takes longer than this to clear, please contact us directly and we will take remedial action.

6.2         Sellyourjewels.com accepts no liability for any inaccuracy in the payment details that you provide to us, or any loss that may occur by payment being sent to an incorrect account, or any delays that may occur, because of an error made by you.

6.3         All timescales quoted in this agreement and on our website are subject to variances and we do not accept liability for any losses that you may incur if for any reason we make a payment outside of these timescales.

6.4         All payment we make are inclusive of VAT and it is your sole responsibility to report and pay any relevant authorities.

7. REJECTION OF GOODS

7.1         We reserve the right to reject any group of items for any reason and shall not be obliged to provide any reason or justification for the rejection of goods to you or any other user of the website.

7.2         If we receive a group of items from a user, we may choose to send you a purchase offer for some of the items and reject the others. In this case, if the user accepts the purchase offer, you enter a contract with sellyourjewels.com for the items specified on the purchase offer only. We will return the rejected items to you, free of charge to the user. If the items are rejected on suspicion of being lost, stolen or counterfeit, we will store your items and report the matter to the relevant authorities, as set out in clause 5.2.

7.3         If your group of items are rejected, we will notify you and return the items at no cost to you. In the event that we attempt to return your items but are unable to for any reason, we will store you items for a period of no more than 28 days after which time your group of items will be deemed abandoned and we will seek to dispose of them at our discretion.

8. YOUR CANCELLATION RIGHTS

8.1         You have a legal right to cancel any contract that you enter with us, without giving any reason, within 14 days (“The Cancellation Period”) of entering a contract with sellyourjewels.com. To exercise your legal right to cancel, please notify us in writing by emailing hello@sellyourjewels.com. Please be aware that “The Cancellation Period” ends immediately at the point that sellyourjewels.com makes payment to you for your group of items and you will no longer have a right to cancel once payment has been sent by us.

9. RESTRICTIONS

9.1         Any user must not send a group of items which is unlawful for you to post or sell, for our chosen courier to handle, or which in our reasonable opinion would be unlawful for us to store or purchase from you. You accept that in the breach of this clause, we are entitled to deal with any such goods as we see fit (including reporting and delivering the items to the police without providing any notice to you) and without making payment to you. You agree to indemnify and hold harmless sellyourjewels.com against any loss or damage we may suffer because of your breach of this clause, including us having to breach any of our statutory obligations due to receiving a group of items that is unlawful.

9.2         You must only send a group of items to us for the purpose of us to complete an appraisal, with the aim for us to purchase the items from you. Whilst you are under no obligation to accept a purchase offer, we do not offer valuations to users who have no intention of selling their group of items.

9.3         Sellyourjewels.com does not provide storage or any service other than an appraisal in relation to your group of items, and reserves the right to charge you for any cost we incur in relation to your breach of this clause.

10. LIABILITY

10.1       In the event that we are liable to you for a breach of this contract, negligence, or any other liability as set out in this agreement, our total liability to you shall be limited to £300.00 per group of items relevant to the claim, and in any event, our aggregate liability to you for all came arising under this agreement shall always be capped at £300.00

10.2       Any claim for missing or damaged items must be submitted by you within 14 days of the item being collected by the courier service, whether that is the item being collected from you to deliver to us, or the item being collected from us to send back to you.

10.3       We shall not be liable for any special indirect, punitive, incidental, special or consequential damages, nor for any loss or damage to Items caused by any third party, nor shall we be liable for any loss of profit, loss of income, loss of anticipated savings, or loss of the use of money.

10.4       Nothing in this agreement shall exclude or limit our liability for any of the following:

10.4.1    Death or personal injury caused by our negligence

10.4.2    Fraud or fraudulent misrepresentation

10.4.3    Any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.

10.5       Nothing in this Agreement shall affect your statutory rights.

11. GENERAL TERMS & CONDITIONS

11.1       You may not transfer this Agreement, nor any of your rights or obligations arising under it, without first obtaining our written consent.

11.2       We may transfer this Agreement, or any of our rights or obligations arising under it, at any time and without providing notice to you.

11.3       We will not be liable for any failure to perform our obligations under the terms of this agreement, if caused by events outside of our control (a “Force Majeure Event”).

11.4       Our performance of this Agreement, or any relevant Contract, will be suspended while a Force Majeure Event occurs and/or renders performance of our obligations impossible, and we will have an extension of time to perform our obligations under the Agreement or Contract for that period. If the Force Majeure Event continues for more than a 28 days we or you may terminate this Agreement or an affected Contract by giving 7 days’ notice in writing.

11.5       Failure by either party to exercise a right granted to it by this Agreement shall not constitute a waiver and will not relieve the other party from compliance with its obligations. A waiver of a right under this Agreement will not be a waiver of any subsequent default. A waiver of a right under this Agreement shall not be effective unless it is stated to be a waiver and is communicated to the other party in writing.

11.6       If any term of this Agreement or any provision of it is determined by any competent authority to be inapplicable, such term, condition or provision will be deleted and the remaining terms, conditions and provisions will continue to be valid.

11.7       We reserve the right to revise this Agreement from time to time to reflect changes to the way we do business, changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our systems capabilities. You will be subject to the Agreement in force at the time that you place an order with us. Where we change or revise this Agreement we will notify you by e-mail using the e-mail address supplied by you using the website’s functionality.

11.8       A person who is not a party to this Agreement shall have no rights in relation to this Agreement under the Contracts (Rights of Third Parties) Act 1999.

11.9       This Agreement shall be governed by the laws of England and Wales and the parties agree that any claim arising out of it or its subject matter shall be subject to the exclusive jurisdiction of the courts of England and Wales.
